Gives a deterrent effect, HPI Management Hopes Foreign Illegal Guide “MY” is severely punished

Badung. Previously, on April 9, 50 Indonesian Tourist Guides Association (HPI) DPD Bali visited the Class I Immigration office, Ngurah Rai on Jalan Perum Jimbaran Number I, Jimbaran, South Kuta District, Badung demanding stricter supervision of foreign workers in Bali.

On Tuesday (17/4/2018) HPI representatives returned to the Immigration Office of Ngurah Rai, Jimbaran, Badung to guard and follow up on their previous report.

A number of HPI administrators led directly by the Head of HPI DPD Bali I Nyoman Nuarta along with two attorneys were received directly by the Head of Immigration Ngurah Rai, Amran Aris before they finally held a closed dialogue.

After having a dialogue with the Head of Immigration Ngurah Rai, the Chairman of the DPD HPI Bali I Nyoman Nuarta admitted that he came with a number of HPI members and two legal representatives who accompanied him to coordinate the legal process against an illegal Chinese guide who committed acts of violence against a member of his community.

He said the legal process against the perpetrator with the initials MY must be carried out as fairly as possible so that it can have a deterrent effect on illegal foreign workers in Bali. In this regard, he believes and believes in the commitment and good intentions of the Head of Immigration Ngurah Rai. According to him, in the dialogue, one of the manifestations of his commitment was the establishment of a supervisory task force with Wasdakim.

“In this case, there were two things that were considered in this dialogue. First, whether it was carried out pro-justice or deportation. Regarding administrative issues, we are still testing the evidence. Later, it will be sorted and selected from two alternatives to be chosen,” he said. .

Meanwhile, the Immigration Head of Ngurah Rai, Amran Aris, said that in this case the most appropriate thing to do to give a deterrent effect was deportation. If deported, the person concerned is banned from entering Indonesia for 6 months and can be extended.

Meanwhile, if you take pro-justice steps, the deterrent effect will not be large because it could only be a minor crime later. He admitted that his party could not immediately provide a ban for more than 6 months due to conflict with regulations. If given a year of ban, for example, it must go through a decision of the Constitutional Court.

“If we are not satisfied, we will direct it to the pro-justitia window. But we are afraid that it will be considered a minor crime. Fines will be imposed. For now, we are still discussing with the HPI whether deportation or pro-justicia,” said Amran, admitting that he had only served two weeks as Ngurah Immigration Head. Rai.

“If I choose deportation, if he invests here, he does not enter Bali for six months, he will lose a lot. But if he is pro-justicia, he is likely to be tipiring. The people are still in Bali,” he explained.

On the other hand, HPI’s attorney, Rado Fridsel L, said that what the perpetrators did in this case was not an administrative act but an immigration crime. He explained that Article 122 of the Immigration Law states that people who carry out activities without a permit have a maximum sentence of 5 years.

He admitted that the suspect had been transferred to immigration last Saturday. At that time Wasdakim admitted that the person concerned had not been able to show his passport.

“This is what we will pursue and guard with HPI. For this case, we are ready to continue to monitor it. Our witnesses and evidence are ready. The perpetrator carried out activities to escort guests (guide). The legal logic is simple, a foreigner comes to a restaurant without maybe in a month we will continue to be there. In addition, we also have evidence of a visit from the person concerned at the restaurant where the crime occurred,” he said.

In order to drag the perpetrators for justice and a deterrent effect, his party has sent a letter to the Bali Police Headquarters and hopes that the letter will get a reply so that it can immediately hear the Bali Police Chief to report this case accompanied by various supporting evidence.

“We have sent a letter to this case accompanied by various evidences. We hope that within this week or next week we can hear or have a dialogue with the Bali Police Chief so that the perpetrators are punished according to their actions,” said Rado ending. (BB).
